This client money handling policy was last updated on 23 May 2024.
This document is to be taken as the Company’s written procedure for Handling Client Money.
These written procedures are set out to ensure compliance with:
UKALA Conduct and Membership Rules;
The Client Money Protection Schemes for Property Agents (Approval and Designation of Schemes) Regulations 2018; and
Any other regulations and statutory requirements as necessary, and to maintain the best practice.
A copy of these client money handling procedures is also available to customers upon request.
Let Students adhere to Client Money Rules of Conduct and use the following procedures.
1. Written Procedures for Handling Client Money
1.1 All Client Money is held in a ringfenced Client Money Account with Lloyds Bank, an authorised bank.
1.2 We operate one or more Designated Client Money Accounts into which all Client Money is paid.
1.3 We ensure that Client Money Accounts are designated as such and are easily distinguished from any other account.
1.4 We have confirmed in writing with the bank holding the Client Money Account that the bank acknowledges that monies in the Client Money Account must not be combined with, or transferred to, any other account maintained by the Business, and the bank shall not be entitled to exercise any right of set off or counterclaim against the money in that Client Money Account in respect of any sum owed to it in respect of any other account of the Business.
1.5 Records and accounts are retained which show all dealings with Client Money and demonstrate that all Client Money held by the Business is held in a Client Money Account.
1.6 We publish our procedures for handling Client Money on our website.
1.7 We provide copies of our procedures for handling Client Money to any person who may reasonably require a copy, free of charge.
1.8 Records are retained which provide a history of all dealings with Client Money.
1.9 Client Money is repaid without delay if there is no longer any requirement to retain that money.
1.10 Client Money is repaid to the client upon request.
1.11 We hold appropriate Professional Indemnity insurance cover.
2. General Controls
Let Students ensure that;
2.1 Any employees with client money contact will always have clear segregation of duties and responsibilities.
2.2 A principal or appropriately qualified individual oversees the client accounting function.
2.3 We employ competent and knowledgeable staff who are responsible for processing clients’ money and are familiar with Client Accounting rules.
2.4 Our accounting systems and client data are securely controlled and protected.
2.5 Our computer systems are adequately protected for access, firewalls, back-ups and disaster recovery.
2.6 There is adequate cover for holiday and long-term absence.
2.7 Principals cannot override controls surrounding the accounting system.
2.8 All areas of the business apply the same level of controls in relation to the client accounting function.
3. Client Bank Accounts
3.1 We hold client money in one or more ring-fenced client accounts, which are separate from all other monies.
3.2 Client money is available on demand.
3.3 The bank account is correctly titled to include the name of the Business and the word “client” to distinguish the account from an office or any other account.
3.4 Interest on client accounts will be treated as client money unless written consent has been obtained by ourselves.
4. Client Accounting Systems and Controls
4.1 Accounting records and systems are appropriate to the nature and volumes of client account transactions.
4.2 Systems provide details of all money received into and paid from all client accounts and show a running balance of all client money held in that account.
4.3 Systems identify all receipts and payments to the client to which they relate.
4.4 Client ledgers show cash balances held on behalf of clients at all times.
4.5 Accounting records are completed chronologically and promptly.
4.6 Current balances and period reports are available upon demand.
4.7 All ledgers include the Client name and reference.
4.8 Overdrawn balances on client ledgers are prevented by systems controls.
4.9 Adequate controls are in place over unidentified client money to ensure that such funds are kept securely.
4.10 A list of client bank account details will be maintained.
4.11 Daily reconciliations are performed. Further reconciliations are completed at least once every month where clients’ money is held in a general client account.
4.12 Any unresolved differences or adjustments are fully investigated and explained.
4.13 Any errors identified in the reconciliation process are promptly rectified.
4.14 In the event that we receive surplus client money into our client account, the following best practice procedure is conducted. First, efforts to trace the clients or owners of the money are made, and any surplus money is held within a client account for at least six years. If, after six years, the client or owner of the money has not been found and no true claimant to the money has come forward it may be donated to a registered charity chosen by Let Students.
4.15 Client accounting records, including copies of reconciliations, are securely kept for at least six years plus the current year.
5. Controls over the payment of Client Money
Let Students ensures that;
5.1 Checks are made to ensure that sufficient funds are held on behalf of the relevant client before payments are made.
5.2 Adequate authorisation procedures are in place for payments made by electronic methods.
5.3 All payment requests have supporting evidence and that documentation has been authorised in advance.
5.4 We do not accept any payments by cash or cheque unless in special circumstances.
5.5 Effective controls are in place over the setting up of new supplier accounts on the system.
